Affidavit, Indemnity Bond and Specimen Signatures for Conversion of DDA Flat from Lease-Hold to Free-Hold (Allottee)
Why This Form Is Important
The affidavit is a sworn legal declaration. The deponent affirms the contents on oath, and the verification states that the contents are correct to the deponent's knowledge and belief and that nothing material is concealed.
It carries real consequences for false statements. The deponent is solely liable for consequences of filling a false affidavit or documents, and DDA reserves the right to cancel the conveyance deed and take action as per law.
It proves possession and status. The deponent declares physical possession of the identified DDA flat as the lessee, sub-lessee or allottee, so the conversion is sought by the person who actually holds the flat.
It confirms the flat is used as permitted. The deponent states the flat is used as prescribed in the lease, sub-lease or letter of allotment and undertakes to stop any use that violates the Master Plan or Zonal Development Plan.
It secures DDA's financial dues. The deponent confirms ground rent is paid and undertakes to pay any arrears with interest, any additional premium resulting from enhanced Land Acquisition compensation (the lessor's decision being final and binding), and maintenance, service charges and any difference in conversion charge before the Conveyance Deed is executed.
It spells out what happens on non-payment. If any of the sums is not paid, the conversion of lease-hold rights into free-hold rights is deemed null and void and the lessor or Authority may recover the amount as arrears of land revenue.
It is a clean-title declaration. The deponent states there is no loan or mortgage from any Government or Private institution, no encumbrance, court case, misuse, legal encumbrance or family dispute, and no unauthorized encroachment.
It vouches for the application and documents. The deponent states the accompanying conversion application is true and correct and the annexed documents are genuine.
The indemnity bond protects DDA from third-party claims. The executant covenants to indemnify and keep the lessor harmless from all claims, demands, actions and proceedings by anyone in respect of the property, on any ground whatsoever.
The bond links the conversion to the executant's representation. Its recitals state that the lessor agreed to convert the lease-hold rights on the faith and representation made to it, subject to the executant giving the indemnity.
The bond is binding beyond the executant. The terms Executant and lessor each include their heirs, successors, executors, administrators and legal assigns.
The bond is signed and delivered in the presence of two witnesses, whose names, fathers' names and addresses are recorded on it.
The last page records attested specimen signatures and passport-size photographs of the person in whose favour conversion is sought, tied to the application number and the flat, with attestation by a notary or First Class Magistrate.
