AFFIDAVIT OF ALLOTTEE/ PURCHASER OF DDA PROPERTY WITH LOAN DISCLOSURE

Affidavit by the allottee or purchaser of a DDA property declaring the relevant ownership or allotment details and disclosing any existing loan, mortgage, or financial liability associated with the property.

Why This Form Is Important

  • It is a sworn statement. The deponent "solemnly affirm[s] and declare[s]" each clause and signs as DEPONENT twice (after the clauses and after the verification), so every statement is a personal, signed declaration. A false sworn statement can carry legal consequences (general knowledge of Indian law, not taken from an official policy document).
  • It ties the declarant to one specific DDA property. The residence block and the property block (DDA property bearing no., floor, pocket, block, area, city, state, pin code) let the receiving authority match the declarant's identity to the exact property the affidavit concerns.
  • It states the declarant's basis for dealing with the property. Clause 1 declares the deponent to be an allottee/ purchaser of the named DDA property, which is the status on which the rest of the declarations rest.
  • It confirms the property is clear when the Conveyance deed is executed. Clause 2 states there is no pending court case, mortgage, dispute, complaint, misuse or sale against the property at the time of execution of the Conveyance deed, so the declaration is tied to the moment the transfer document is signed.
  • It discloses the lender. Clause 3 records the bank from which the declarant has taken a loan, so the authority knows a bank is involved with the declarant. The form does not say how the loan relates to the property or why it must be disclosed (a lender may hold a claim over the property; that is general knowledge, not from an official policy document).
  • It records when and where the statement was verified. The verification block (day, month, year and place) fixes the date and location of the declaration and confirms the contents are true to the declarant's knowledge and belief, with nothing material concealed.
