Affidavit declaring ownership of a property and confirming that it has not been sold, mortgaged, transferred, or subjected to any encumbrance, charge, or third-party claim.
Why This Form Is Important
It is a sworn statement. The deponent "solemnly affirm[s] and declare[s]" each clause and signs as DEPONENT twice (after the clauses and after the verification), so every statement is a personal, signed declaration. A false sworn statement can carry legal consequences (general knowledge of Indian law, not taken from an official policy document).
It ties the declarant to one specific property. The residence block and the property block (house/property no., floor, pocket, block, area, city, state, pin code) let the receiving authority match the declarant's identity to the exact property the affidavit concerns.
It is the declarant's own assertion of ownership. Clause 1 states that the declarant is the owner of the named property.
It declares that the property has not been sold or mortgaged. Clause 2 states the declarant has neither sold nor mortgaged the property, so the receiving authority has the owner's sworn word that no sale or lender's charge exists.
It covers informal transfers. Clause 2 also states that no GPA/ Agreement to sell has been executed for the property. Such documents can pass rights in a property without a registered sale, so this statement closes that gap (general knowledge, not taken from an official policy document).
It declares the property free of encumbrances and disputes. Clause 2 states the property is free from all kinds of encumbrances and that there is no dispute, court case or litigation, which helps the authority proceed without unresolved claims.
It confirms the owner's constitution has not changed. Clause 2 states there is no change in constitution of firm/ Company, which suggests the form can be used where the property is held through a firm or company, so the owner on record is still the same entity (inferred from the wording).
It records when and where the statement was verified. The verification block (day, month, year and place) fixes the date and location of the declaration and confirms the contents are true to the declarant's knowledge and belief, with nothing material concealed.
