Affidavit by the allottee or owner declaring possession of a DDA plot and confirming that the property is free from any mortgage, in support of its conversion from leasehold to freehold.
Why This Form Is Important
It is a sworn statement. The deponent "solemnly affirm[s] and declare[s]" each clause and signs as DEPONENT twice (after the clauses and after the verification), so every statement is a personal, signed declaration. The opening words "I/We" show it can be made by more than one person. A false sworn statement can carry legal consequences (general knowledge of Indian law, not taken from an official policy document).
It identifies the declarant and where they live. The residence block (house/property no., floor, pocket, block, area, city, state, pin code) records who is making the declaration and their address for the authority's records.
It states the declarant's position on the plot. Clause 1 declares that the deponent is in physical possession of a named DDA Plot (plot number, block, area, Delhi). Note that the form speaks of possession, not ownership, so it is the possession claim that the rest of the declarations rest on.
It declares the plot free of disputes and transfers. Clause 2 states there is no pending court case, mortgage, dispute or sale, in full or in part, against the property, so the authority has a sworn statement that no lender or buyer holds a claim on it.
It declares the plot free of encumbrances. Clause 2 states the property is free from all sorts of encumbrances, which covers any other burden not listed by name.
It vouches for the documents submitted for the conversion. Clause 2 states the documents submitted in connection with the conversion are genuine, which puts the declarant on record about the accuracy of the rest of the submission. The form does not say what is being converted; that depends on the authority's scheme and is not in the form.
It confirms the contents on the declarant's knowledge and belief. The verification states that the contents are correct to the declarant's knowledge and belief and that nothing material is concealed, with the place of verification fixed as New Delhi. Unlike the other affidavits in this set, this verification has no date or fill-in fields.
