A legal agreement between a landlord and tenant specifying the rent, security deposit, duration of tenancy, property details, and terms and conditions of renting a property.
Why This Form Is Important
It creates the tenancy on paper: the agreement names the Lessor and the Lessee with their relation to a father or husband and their addresses, and identifies the premises let out by property number, floor, street, area, state and pin code.
It fixes the money terms: the Lessee pays a stated monthly rent in advance on the 5th of each English calendar month, and an interest free security deposit that is adjustable in the rent.
It defines the term and renewal: the lease runs for 11 or 12 months between stated start and end dates, and can be extended by mutual consent with a 10% increase in rent.
It limits how the premises are used: the use is stated as residential or commercial, and subletting is not allowed without the Lessor's prior written permission.
It divides responsibility: the Lessee pays electricity, house tax and water bills as per the meter reading and handles minor repairs, while the Lessor handles major repairs at his or her own cost.
It sets out how the tenancy can end: either side can terminate on one month's written notice, non-payment of rent in time cancels the lease, and the Lessee must hand back vacant possession peacefully in neat and clean condition.
It names the forum for disputes: any dispute goes to the courts of Delhi.
It is executed before witnesses: the Lessor, the Lessee and two witnesses sign. Note: that a signed written agreement helps prove the tenancy to third parties is general knowledge, not something stated in the form or sourced from an official policy document supplied here.
