Sale Deed, Property Sale Deed, Deed of Conveyance, Property Transfer, Transfer of Ownership, Immovable Property, Seller and Buyer Agreement, Real Estate Documents, Property Registration, Sale of Property, Legal Property Documents
Legal document recording the transfer of ownership of immovable property from the seller to the buyer for an agreed consideration.
Why This Form Is Important
It transfers legal ownership: the VENDOR sells, conveys and transfers all rights, title and interest in the said property to the VENDEE(S), who become the absolute owner, and the deed states that nothing further can be claimed by the VENDOR or the VENDOR's heirs.
It is the written record of the price: the deed states the total sale price and the full and final consideration received, with a payment table of amounts, cheque or UTR numbers, dates and banks, and records that nothing is left due.
It records the tax deducted: the payment table shows TDS at 1% of the total sale consideration deducted by the VENDEE(S), for which the VENDEE(S) must issue the TDS certificate.
It documents the chain of title: the recitals trace the society membership, the lease deed, the flat allotment, any earlier sale, and the conversion from leasehold to freehold by Conveyance Deed, each with document, book, volume and page details of its registration.
It protects the buyer through warranties: the VENDOR assures the property is free from encumbrances, disputes, HUF or minor ownership and legal defects, and agrees to indemnify the VENDEE(S) for losses if the title fails.
It supports mutation and utility transfers: the VENDEE(S) are authorised to mutate the property in their name with the Municipal Corporation of Delhi and to transfer electricity and water connections by presenting the deed or a certified copy.
It fixes responsibility for dues and possession: the VENDOR pays all taxes and bills up to handing over vacant physical possession, and the deed records that possession and the original documents were delivered at execution.
It records who bore the costs: stamp duty, registration charges and advocate charges are borne by the VENDEE(S), and the property details section lists the stamp duty and corporation tax payable.
It includes Form A and a verification: Form A gives the transferor, transferee and property particulars, and the transferor verifies that the statements are true to the best of their knowledge and belief. Note: the general importance of registering a sale deed and paying stamp duty is general knowledge about property practice in Delhi, not something sourced from an official policy document supplied here.
